Refund policy
1. Nature of the service and right of withdrawal
Fotelya is a digital service provided immediately after subscription: the sharing space is created and accessible without delay. In accordance with article L221-28, 13° of the French Consumer Code, the fourteen (14) day withdrawal period does not apply to the provision of a digital content or service whose execution has begun, with the consumer's prior express consent and their express waiver of this right. By subscribing to a paid offer, you expressly request the immediate execution of the Service and acknowledge waiving your right of withdrawal, as specified in our Terms and Conditions.
2. Try before you buy
The Free (0 €) offer lets you discover how the Service works without commitment and without a credit card. We invite you to use it to confirm that Fotelya meets your needs before any paid subscription.
3. Cases eligible for refund
A full or partial refund may be granted, after review in good faith, particularly in the following cases:
- Non-conformity of the Service within the meaning of the legal guarantee of conformity applicable to digital services (articles L224-25-12 and following of the French Consumer Code) ;
- Prolonged unavailability attributable to Fotelya that prevented you from using the Service during your event;
- Billing error (duplicate payment, incorrect amount).
The following do not, however, entitle you to a refund: a change of mind after access is opened (see §1), cancellation or postponement of your event for reasons not attributable to Fotelya, or failure to use the Service during its validity period.
4. How to request a refund
Write to contact@fotelya.com indicating the email address used for your purchase and your order reference (it appears on your receipt). As payments are processed by our provider Paddle, which acts as the official merchant (Merchant of Record), any approved refund is processed by Paddle on the original payment method. You can also use the support link on your Paddle receipt.
5. Timelines
We respond to all requests within 7 business days. After validation, the refund is processed by Paddle; the credit usually appears within 5 to 10 business days depending on your bank or card issuer.
6. Legal guarantees
This policy does not deprive the consumer of any public order protection: it applies without prejudice to legal guarantees, including the legal guarantee of conformity for digital content and services, and any applicable mandatory provisions.
7. Complaint and mediation
If a persistent disagreement arises after submitting a written complaint to Fotelya, you may contact free of charge the consumer mediator to which we belong: CM2C (Centre de la Médiation de la Consommation de Conciliateurs de Justice), 49 rue de Ponthieu, 75008 Paris: online submission at cm2c.net or by email at litiges@cm2c.net.
